Fair Trading Terms

We act as agents for SAS Kawan Group of Château de Simard, 16 Route de Louhans, 71330 Simard, France ("SAS Kawan Group") in respect of the sale of Camping Cheques. We also act as agents for Alan Rogers Travel Limited of Spelmonden Old Oast, Goudhurst, Kent TN17 1HE ("ART") who are the authorised agents of the ferry operators featured in our brochure and on our website in respect of all bookings of ferry crossings. References in these terms to ferry operators or a ferry operator means all such operators or the one with whom you have a booking, as the context requires.

Throughout these terms, 'we', 'us' and 'our' means Alan Rogers Guides Limited of Spelmonden Old Oast, Goudhurst, Kent TN17 1HE ("ARG") acting in the capacity of agents for SAS Kawan Group and/or ART as agents of the ferry operators. 'You' and 'your' means the person who purchases the Camping Cheques or makes the ferry booking ("lead name") and all persons travelling with him / her who use or have the benefit of the Camping Cheques and/or travel on the ferry booking (including anyone who is added or substituted at a later date) or any of them, as the context requires. The lead name must be at least 18 at the time of booking. References to booking(s) mean the purchase of Camping Cheques and/or booking of a ferry crossing or crossings.

These terms set out the basis on which you purchase Camping Cheques and/or make your ferry booking. They also govern your relationship with ARG. Please read them carefully. By asking us to confirm your booking, we are entitled to assume that you have had the opportunity to read and have read these terms as well as the applicable terms of SAS Kawan Group and/or the ferry operators (see clause 1 below) and agree to them. The lead name must be authorised to make the booking on the basis of these terms by all persons on whose behalf the booking is made.

When you purchase Camping Cheques and/or book a ferry crossing with any of the ferry operators and your booking is accepted as set out below, you will enter into a contract with;-
(i) SAS Kawan Group for all Camping Cheques purchased and/or
(ii) the ferry operator for the ferry crossing booked.

Your contract comes into force when we accept your booking over the telephone, via our website or otherwise in writing and you make the payment required at the time of booking. The terms and conditions of SAS Kawan Group and/or the ferry operator apply to your contract. Those terms and conditions which are most relevant to the making and administration of your booking are set out in these terms. However, these terms do not include a complete set of the terms and conditions of either SAS Kawan Group and/or the ferry operators. A complete set of these terms or the means of obtaining them are available on request. We will also provide you with a copy of these terms or this information with your confirmation invoice. The ferry operators' full terms and conditions are available on their respective websites.

Full payment for your Camping Cheques and/or ferry crossing must be made at the time of booking.

We will confirm your booking by issuing a confirmation invoice on behalf of SAS Kawan Group and/or the ferry operator(s). This invoice will be sent to the lead name. Please check this invoice carefully as soon as you receive it. Contact us immediately if any information on the confirmation or any other document appears to be incorrect or incomplete as it may not be possible to make changes later. We regret we, SAS Kawan Group and the ferry operator cannot accept any liability if we are not notified of any inaccuracies (for which we, SAS Kawan Group and/or the ferry operator are responsible) in any document within 10 days of our sending it out (5 days for tickets). We will do our best to rectify any mistake notified to us outside these time limits but you must meet any costs involved in doing so.

If you wish to cancel your booking, the lead name must notify us in writing as soon as possible. The cancellation will only be effective when received by us in writing. You may e-mail us with your cancellation to enquiries@campingcheque.co.uk 100% cancellation charges are applicable to Camping Cheques once purchased and refunds can only be made in exceptional circumstances as referred to in 4.9 below. Exchanges of expired but unused Camping Cheques may be possible as referred to in 4.10 below. The cancellation charges applicable to a cancelled ferry booking depend on the terms and conditions of the ferry operator. 100% cancellation charges from the date of booking apply to certain routes. Please check the position at the time of booking.

4.1 Camping Cheques are available in paper voucher format or digital format. In the latter case the Camping Cheques purchased are credited to the following chip cards: Gold Card or Silver Card.

4.2 One Camping Cheque is valid for one night for two people on a standard pitch with car, caravan, tent or motor home. Electricity and the use of an awning are included in the price. 4.3 Camping Cheques do not include any local tourist taxes which may be payable locally. 4.4 Subject to 4.9, Camping Cheques cannot be reimbursed or refunded if lost, destroyed, stolen or unused and are not transferable. In the case of Gold and Silver Cards, it is usually possible to replace a lost or stolen card and restore unused Cheques but an administration charge may apply.

4.5 Camping Cheques in paper format are made up of two parts which must be intact when handed to the campsite who may otherwise refuse to accept it.

4.6 Camping Cheques are only valid for use at campsites participating in the Camping Cheques scheme. As Camping Cheques are a low season scheme, each campsite accepts Camping Cheques during limited dates. It is your responsibility to check validity dates for individual campsites. Please see details of participating campsites and the Camping Cheques acceptance dates in the Camping Cheque Site Directory for the relevant year available on request or at www.campingcheque.co.uk.

4.7 The price of each Camping Cheque is £13.95 based on a Euro/Sterling exchange rate applicable on 1st October 2012. We reserve the right to increase the price of Camping Cheques at any time prior to purchase if the exchange rate changes adversely. If the price of a Camping Cheque has increased at the time of booking, you will be advised accordingly. The cost of Camping Cheques will not increase once payment has been received.

4.8 Subject to 4.7, prices are valid for Camping Cheques purchased between 1st October 2012 and 30th September 2013. Each Camping Cheque is valid for use between 1st January 2013 and 31st December 2014.

4.9 Camping Cheques are not normally refundable except in the unusual circumstance of the death or medical incapacity of the lead name or the lead name's spouse. Full details of conditions relating to refunds in exceptional circumstances are available on request.

4.10 The exchange of expired but unused Camping Cheques may be possible. Any exchange must be requested within 4 months of expiry and will incur a charge for administration. If the price of Camping Cheques has increased since original purchase, the difference in price must also be paid for each Camping Cheque exchanged.

5.1 As Camping Cheque is a low season scheme, pitch reservations are not normally necessary. If you would like to make a reservation for a pitch this must be made directly with the campsite. ARG has no involvement with or responsibility for the making of reservations or availability of pitches.

5.2 You must abide by the rules and regulations of the campsite. In particular you are expected to be considerate towards everyone you come into contact with during your stay. If you fail to observe such rules or behave in such a way as to cause or be likely to cause (in the opinion of the campsite owner or management) danger, distress or annoyance to anyone or damage to property, the campsite owner or manager will be entitled without notice to terminate your occupation of the campsite and ask you to vacate immediately. In this case no refunds will be made and the cost of any damage must be paid for by you.

5.3 You agree to accept the pitch allocated by the campsite.

5.4 You must take reasonable precautions for your own safety and ensure the proper supervision at all times of all children travelling with you including while using any swimming pool or other campsite facilities.

5.5 In low season and during periods of bad weather, you must accept the provision of campsite services and facilities may be restricted. Where specific opening dates are not given, this should not be taken as an implied guarantee of their availability all season.

Ferry operators limit their liability in accordance with the provisions of the Convention Relating to the Carriage of Passengers and their Luggage by Sea 1974 ("The Athens Convention") and other applicable legislation. For any claim involving death or personal injury or delay or loss of or damage to luggage arising out of any ferry crossing and/or the process of getting on or off the ship concerned, the only liability ferry operators have to you is in accordance with The Athens Convention. Any claims covered under The Athens Convention must be made within the time limits set out in The Athens Convention. Strict time limits apply in relation to the notification to the ferry operator of any loss or damage of luggage. See the terms and conditions of the ferry operators for more information.

7.1 Should you experience a problem, please notify the campsite owner / manager or the ferry operator straight away who will normally be able to help you. If you remain dissatisfied, please follow the applicable complaints procedure of SAS Kawan Group or the ferry operator. We act only as agents and whilst we agree to pass any complaint on to SAS Kawan Group or the ferry operator which we receive from you, they are responsible for responding to and resolving any complaint you may have. Contact details are available on request. 7.2 For the purchase of Camping Cheques, your contract with SAS Kawan Group will be governed by French law. For ferry bookings, your contract with the ferry operator will be governed by the law specified in the ferry operator's terms and conditions.

We act only as agents for SAS Kawan Group and as agents for ART who are the authorised agents of the ferry operators. Our responsibilities are limited to administering your booking in accordance with these terms and conditions and making available the Camping Cheques purchased and/or the means of accessing your booked ferry crossing. We and ART are not liable for the acts or defaults of SAS Kawan Group or the ferry operators or any of their employees, agents, suppliers or sub-contractors, the use or honouring of any Camping Cheques or the performance of any ferry crossing. In the event that we are found liable to you on any basis, our maximum liability is limited to the cost of the Camping Cheques and/or ferry crossing to which your claim relates. We do not, however, exclude liability for death or personal injury resulting from the negligence of ARG or any of its employees.

In order to process your booking, we need to use the information you provide (such as name, address, any special needs etc). We take full responsibility for ensuring that proper security measures are in place to protect your information. We must pass the information on to SAS Kawan Group, the ferry operator and/or ART, as applicable. The information may also be provided to public authorities such as customs/ immigration if required by them, or as required by law. This applies to any sensitive information that you give to us such as details of disabilities, or dietary/religious requirements. In making this booking, you consent to this information being passed on to the relevant persons).

We will hold your information, where collected by us, and may use it to inform you of offers or to send you brochures. If you do not wish to receive such approaches in the future, please write to us at Spelmonden Old Oast, Goudhurst, Kent TN17 1HE.
